The Makurdi Zonal Command of the Economic and Financial Crimes Commission, EFCC, on Friday April 29, 2022, secured the conviction of one Damian Oragbai Terhemba before Justice M. A. Ikpambese of the Benue State High Court sitting in Makurdi, on one count charge of misappropriation to the tune of N1,906,000 (One Million, Nine Hundred and Six Thousand Naira only).

The charge reads: "That you, Damian Oragbai Terhemba between 2017 and 2018 in Makurdi within the jurisdiction of this Honourable Court, being entrusted with the sum of N1,906,000 (One Million, Nine Hundred and Six Thousand Naira only) by one Iortule Aondowase for the purchase of a Toyota Corolla Car 2005 Model, dishonestly misappropriate the said sum and thereby committed an offence, contrary to Section 312 of the Penal Code (CAP) 124 Law of Benue State, and punishable under Section 313 of the same Law".

He pleaded not guilty to the charge setting the stage for trial to commence.

In the course of the trial, the prosecuting counsel, George Chai-Yakua, called two witnesses and tendered several documents. Upon closing his case, the convict filed a no case submission but the same was dismissed.

Justice Ikpambese in his judgment today, pronounced Damian guilty and sentenced him to six months imprisonment without option of fine.

Also, the convict was ordered to return the said sum of N1, 906,000 as a restitution to the victim.
